Adam Moskowitz, an attorney involved in multiple crypto-related lawsuits, submitted a filing requesting to depose former Binance CEO Changpeng “CZ” Zhao in relation to a $1 billion class action case against Binance over allegedly unregistered securities. Moskowitz argued CZ has “unique knowledge” crucial to issues in the lawsuit, which a judge previously ordered stayed.
Moskowitz has represented crypto investors and victims in various cases targeting major industry players like FTX. With CZ recently pleading guilty to U.S. charges and facing sentencing in early 2024, the lawyer aims to question him while access seems more assured. Moskowitz suggested CZ’s admissions around Binance lacking safeguards could bolster claims in the civil case as well.
The lawyer further noted the uncertain outcome for CZ in upcoming criminal proceedings, from potential decades in prison to no jail time, makes securing his testimony now prudent.
Moskowitz also referenced the SEC’s ongoing allegations against Binance’s BNB token being an unregistered security, risks which still cloud the $4 billion value reached in CZ’s settlement deal with U.S. authorities. With Binance leadership and operations in flux, the door could soon close on examining CZ over disputed practices alleged in the investor lawsuit.
